Terms and Conditions
1. General terms
1.1. These Terms and Conditions of Use (“Terms”) apply in respect of Your relationship with the online service at dual4mind.eu (including, but not limited to, e-mails, live sessions, messaging, worksheets and the sections of our online therapy programs), through which counselling may be provided, operated by AUTENTA j.d.o.o. Rijeka, Janeza Trdine 2, PIN: 03673358100 and/or Self4Self d.o.o. Klovićeva 9, Zagreb, PIN: 74415405178 (“Service Provider”). If there is no other statement, use of dual4mind.eu is always regulated, at least, with these Terms.
1.2. Thank you for visiting website dual4mind.eu (“dual4mind.eu”, “We”, “Us”, “Our”), Website dedicated to Integrative and EMDR psychotherapy. The Service shall be used to connect you with a Counselor who will provide services such as counselling, consulting and professional advice to you. (the “Counselor Services”).
1.3. Please be advised that existing content on our website is provided for general information only. We try to ensure that our website is accurate and up to date. We may sometimes make mistakes and cannot guarantee the accuracy of the information on our website or that you will always be able to access it.
2. Definitions
2.1. Psychotherapy is and independent interdisciplinary scientific activity based on scientific principles and methods. Aim of psychotherapy is to:
1) establish a relationship between one or more persons and one or more psychotherapists through the psychotherapy process in order to encourage personal development, removing, modifying or alleviating the intensity of existing psychosocial, psychosomatic and behavioral disturbances or sufferings and developing more functional and appropriate patterns of experiencing and behavior, relationships with the environment and value system;
2) establish a relationship between one or more persons and one or more counselling therapists through a counselling process with the aim of helping to identify current difficulties in order to find the best solution through improving communication skills, strengthening self-esteem, promoting behavioral change and optimal psychophysical health.
2.2. “Service” is one or more of services: Integrative psychotherapy, EMDR psychotherapy, Business performance development or EMDR supervision. Accurate and up to date definition of services is provided on our website.
2.3. “Therapist” or “Counselor” is legally entitled medical expert providing services of psychotherapy.
2.4. “You”, “User”, “Service user” “Your” and “Yourself” refer to individual user of the Service”.
2.5. “Territory” are only places where Service might be used, and means territory of European union county members.
2.6. “Appointment” means an arrangement to meet via video call or in person Therapist at precise date and precise time.
3. Appointment Reservation
3.1. You may request an Appointment only if you are at least 18 years of age, or if in country of Your residence age majority is higher than 18, then You have to be aged at least age You become major. By accepting Terms, you state that you have minimum age required by Terms.
3.2. Service does not require registration or user account management, rather only appointment reservation.
3.3. In order to reserve an appointment, you must click on “Book your appointment”; where you will be sent to page where you can select your Therapist. After you select your Therapist, you will need to fill your full name and your e-mail account, and accept these Terms and Conditions and our Privacy Policy. Next step is to select Service from provided list. When Services is selected You will be able to choose appointment on provided calendar. Finaly, when appointment is chosen you will be redirected to page with payment instruction.
3.4. We will save your chosen appointment for 3 working days, in which time you must make your payment and payment must be visible on Our bank account. Please be aware that only when payment is visible on Our bank account your appointment will be officially approved. You will get an email with information that appointment is officially approved.
3.5. Once agreed and with payment approved appointment can be cancelled or rescheduled only with our acceptance. If you do not agree on such cancelation or reschedule you will be fully charge for an Apointment.
3.6. During Appointment you might book next Appointment and in such case these Terms and Conditions apply on all further Appointments. Same terms apply if further appointments are booked via other ways of communication such as e-mail, phone etc.
4. Service
4.1. If otherwise not agreed, Service will be made via video-call platforms, such as: GoogleMeet. Please be aware that all platforms are third party platforms and we do not take responsibility on functioning of such platforms. Prior to an appointment we will send you a link and information about third party service provider through which you will be able to access an Appointment. It is your obligation to ensure your computer and internet connection is suitable for use of such third-party service provider, and that you have fully functional speaker, microphone and camera, or otherwise, you are obliged to inform us, at least 24 hours before an appointment that you will not be able to participate due to computer or internet connection reasons.
4.2. When appointment is not possible due to technical issues appointment shall be rescheduled in time agreed.
4.3. You are entitled to our Service only if you are resident of European union country member. By accepting Terms, you state that you have residency in European union country member.
4.4. During your First appointment with selected Therapist and selected Service, you will be requested to submit your medical documentation, if there is any, and to provide insight of your issue. Also, you will be requested to name your first contact person, with full name, phone number and e-mail in case Therapist assesses that there is risk of self-harm or harm to another person.
4.5. Once started, Therapist is allowed to stop and cancel any appointment if Service User breaches this terms and conditions, or in any way offends, slanders or lies about Therapist or any other person, threatens Therapists or any other person, or in any other way creates a feeling of insecurity and discomfort in the Therapist. In such case Service user is not entitled for refund for same Appointment.
5. Price
5.1. Prices on Website are expressed Euro (EUR) and/or local currency. Price is expressed with a value added tax (VAT) included.
5.2. Price is determined per appointment. We enter prices from our valid price list on day of appointment schedule.
5.3. You can pay for scheduled appointment via credit card or through a bank transfer. In case when appointment is cancelled (with our acceptance of it) you will be entitled for refund. If we have to cancel an Appointment before start of it, You shall have options either book another Appointment or for full money refund. Payment will be made only on bank account money came from. We shall not bear any costs of bank transfer of refund; thus, such cost shall be deducted from refund amount.
6. Your obligations
6.1. After you have accepted Terms and Conditions and requested an Appointment you are obliged to inform Us immediately of any claim or action against you for any use of Service.
6.2. You must not misuse Our website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our website, the server on which our website is stored or any server, computer or database connected to our website. You must not attack Our website via a denial-of-service attack or a distributed denial-of-service attack.
6.3. When Our website contains links to third parties’ websites it is for your information only. We have no control over the content of those sites or resources and we do not endorse or accept liability for the content of them.
6.4. We might post website links to pages maintained by us on third party social media websites. When you use those pages, you must do so under their terms of use and these Terms.
6.5. You may link to our website pages that are open to the general public, only if you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
6.6. We reserve the right to withdraw linking permission without notice.
7. Breach of Terms
7.1. It is in Our own discretion to determine whether there has been a breach of Termes by Service users.
7.2. If such breach occurs, We may take actions:
- immediately, temporarily or permanently withdraw your right to use our Service;
- give you a warning; undertake legal proceeding against you for reimbursement of all losses and costs on an indemnity basis – including, but not limited to, reasonable administrative and legal costs – resulting from the breach;
- further legal actions against you;
- disclosure of such information to law enforcement authorities as we reasonably feel it necessary.
7.3. We exclude liability for actions taken in response to breach of this acceptable use policy. The responses described in this policy are not limited we may take any other action we reasonably think is needed.
7.4. If breach of Terms shall be considered as criminal activity, we will inform public authorities on such breach as well, if necessary, conduct private proceeding against you for reimbursement of all losses and costs.
8. Change of Terms
8.1. We are entitled to change Terms without prior notice to You. If such change of Terms drastically changes Your rights given to You by Terms, we will notify You via email address You provide us. We advise you to check terms regularly. By continuing to use our website you agree to be bound by any changes we make to Terms.
8.2. If We change Terms in such way that Services we provide are no longer ones you applied for, you are entitled to breach any contracts we had.
9. Users’ Personal Data
9.1. If otherwise not stated in our Privacy policy on Users personal data those terms should apply.
9.2. Your privacy and personal data is important to us. In order to provide our Service, we have to collect your personal data. It is important that you read our Privacy policy before creating user account. If otherwise not stated in these Terms we shall not share or reveal any of your personal data. All personal data will be used only for purposes of our Service and website management. It is your right to be informed about any personal data.
9.3. Please note that we respect Therapist confidentiality and you should feel safe to share your private information during Appointment. Only in cases we consider exceptions, there could be limits to full confidentiality. These cases are left to the Therapist’s discretion. Such exceptions are: planned self-harm intent; planned violence towards others; past, present or planned child abuse; elderly or dependent adult abuse.
10. Limitations of liability
10.1. In the event of any Problem with the Service, your sole remedy shall be to cease using the Service. Under no circumstances shall We, or any other third-party service, be liable in any way for Your use of the Platform or any of its content, including but not limited to, any errors or omissions in any content, any infringement by any content of the intellectual property rights or other rights of third parties, or for any loss or damage of any kind incurred as a result of use of any content.
10.2. Under no circumstances shall We, or any other third-party service, be liable for any punitive, exemplary, consequential, incidental, indirect or special damages (including, but not limited to, personal injury, lost profits, business interruption, loss of programs or other data on your computer or otherwise) arising from or in connection with your use of the Service, whether under a theory of breach of contract, negligence, strict liability, malpractice or otherwise, even if the We or any third party have been advised of the possibility of such damages.
10.3. We shall not be liable to Service User or to any third party for any indirect, incidental, consequential, special, punitive or exemplary damages.
10.4. If, by any meany, we are to be liable for any damage to Service Users, aggregate liability for all damages will not exceed the total amount of money paid by Service User or on Service User provider. If applicable law does not allow the limitation of liability as set forth above, the limitation will be deemed modified solely to the extent necessary to comply with applicable law.
10.5. You shall release and hold Us for all causes of actions and claims resulting from the Services, such as but not limited to acts, omissions, opinions, responses, advices, suggestions, information.
11. Law application
11.1. Service is provided from Croatia, under the Law of Croatia. All our Therapists have authorization to perform Therapy in all European union country members. Thus, when European union law that obliges Croatia, or other countries in EU, regulates any scope of Service, such law shall be applied.
11.2. When any provision from this Terms is not in accordance with applicable legislation, such provision shall be replaced with other suitable provision, closes to business purpose contract was signed between parties, with consideration of rights from both parties.
11.3. In case of a dispute which cannot be settled by negotiation, they shall be under the jurisdiction of authorized court in Zagreb. Croatian Law applies.
